Forming A New Government For Holding Elections

February 13, 2013: speaking at a mass rally held by the UCPN-Maoist at Tundikhel in Kathmandu yesterday on the occasion of the 18th People's Revolution Day and Seventh Unite General Convention Publicity Meeting, Prime Minister Dr. Baburam Bhattarai also the Vice-chairman of the ruling UCPN-Maoist said that he was ready to discuss about the interim constitution with the advocates, and added, “Formation of the new election government under the chief justice was constitutional.” He said that the new constitution would be promulgated through the CA and added that the opposition parties were responsible for the current political and constitutional mess, according to the news posted on Gorkhapatraonline.com today.
Speaking at a mass rally held by the UCPN-Maoist at Tundikhel in Kathmandu yesterday, Chairman of UCPN-Maoist Prachanda said that the interim constitution allowed forming a new government under the chief justice when the country was in a critical situation. He added, “If all parties are ready to hold the CA election in April or May, we are prepared to form the new government under the chief justice,” according to the news posted on Gorkhapatraonline.com today.
Chairman Prachanda further said that the Interim Constitution has a provision for forming a government under the chief justice but intellectuals in the country failed to spot the provision; in addition, it was an international practice to entrust the chief justice for a way out whenever the nation was in crisis, according to ‘HIMALAYAN NEWS SERVICE’ of yesterday.
The CPN-UML meeting held at the Balkhu party central office yesterday said that the party was against the government led by the Chief Justice. The CPN-UML Central Committee (CC) informal meeting concluded that the nation could not go for the fresh Constituent Assembly (CA) election under a government led by the Chief Justice. The CPN-UML said having the same person as the Chief of the Judiciary, the Legislature and the Executive would be against the theory of separation of power, according to the news posted on Gorkhapatraonline.com today.
Nepal Bar Association (NBA) and constitutional experts on Monday, February 11, 2013 formally urged President Dr. Ram Baran Yadav not to appoint chief justice Khil Raj Regmi as a new Prime Minister. "The Article 106 of interim constitution has clearly mentioned that the sitting CJ or justices should not be assigned for any task. Addressing the tea reception party held at Bhrikuti Mandap to mark the 18th people’s war day yesterday, Chairman of CPN-Maoist Mohan Baidhya said that his party would oppose all decisions including the formation of a government made by four parties. Chairman Baidhya said, “Four parties alone cannot give a way out to the nation’s impending crisis.
