No Registration Of Petition Against Appointment Of Karki

May 7, 2013: the Supreme Court of Nepal yesterday refused to register the petition filed by Om Prakash Aryal against the recommendation made by the Constitutional Council to the president for appointing Lokman Singh Karki to the chief of the Commission on Investigation into Abuse of Authority (CIAA), according to the news in ‘gorkhapatra’ of today.
Advocate Om Praksh Aryal has said in his petition that the recommendation for appointing Kakri to the chief of the CIAA goes against the Interim Constitution of Nepal of 2007; so he has demanded not to enforce the recommendation for appointing Karki to the chief of CIAA.
Assistant spokesman for the Supreme Court of Nepal Hemant Rawal said that the petition was neither registered nor refused because it did not contain the documents informing the parties the petition was to file against; if the petition were to file at the court with the required documents then the court would decided whether to reject or register the petition, according to the news in ‘gorkhapatra’ of today.
President Dr Ram Baran Yadav yesterday did not appoint Karki to the chief of the CIAA following the recommendation of the Constitutional Council but started off the study on the constitutional and legal factors of the case, according to the press advisor Rajendra Dahal of the president.
At the same time, different organizations have protested against the appointment of Karki to the chief of the CIAA. Professional organizations, and human rights organizations have issued statements demanding to revoke the recommendation for appointing Karki to the chief of the CIAA. They also have submitted written petitions against Kakri at the office of the president demanding to annul the recommendation made for the appointment of Karki to the chief of CIAA
A team of CPN-UML headed by General Secretary Ishwor Pokharel went to the office of the president, and submitted a written request to the president for not appointing Karki to the chief of the CIAA.
One of the mid-level leaders of the NC Dr Ram Sharan Mahat said that the decision on appointing Karki to the chief of the CIAA was of the central committee of the NC so there was no question of not appointing Kakri to the chief of the CIAA.
