Nepal Army’s Move On Fresh Recruitments

April 20, 2010: the Nepal Army has published an ad for fresh recruits on Monday, April 19, 2010 provoking strong reactions from the UCPN-Maoist leaders and drawing a law suit at the Supreme Court of Nepal.
The UCPN-Maoist leaders have said that the Nepal Army is attempting to make fresh recruitments in violation of the Comprehensive Peace Agreement (CPA) the Government of Nepal has reached with the Maoists in 2006 and the Nepal Army has done it to derail the peace process and the writing of a new constitution.
Executive Director of International Institute of Human Rights, Environment and Development (INHURED), Advocate Shree Krishna Subedi has filed a writ petition at the Supreme Court of Nepal against the Nepal Army’s move on initiating fresh recruitments stating it goes against the Interim Constitution of Nepal of 2007, the Comprehensive Peace Agreement and its supplementary agreement on arms and army management, and the previous ruling of the Supreme Court of Nepal on this matter.
Last year the Supreme Court of Nepal in its ruling on the similar case has stated that it goes against the article 5 (1) and (2) of the Comprehensive Peace Agreement, and articles 144 and 147 of the Interim Constitution of Nepal of 2007, so ordered the Nepal Army not to make new recruits according to the news on the state-run newspaper ‘Gorkhapatra’ of April 20, 2010.
