Legalizing Actions Of People’s Court And Government

Issue 04, January 22, 2012

By KTM Metro Reporter

January 18, 2012: the current coalition government of UCPN-Maoist and UDMF made a decision on legalizing the sale and purchase of land, and division of property done by the people’s courts and government set up by the Maoists during the people’s war provoking strong opposition from the NC and CPN-UML leaders in the parliament yesterday; lawmakers belonging to the NC and CPN-UML disrupted the House session demanding immediate withdrawal of the cabinet decision on legalizing the actions of the people’s court and the government.

Leaders of NC and CPN-UML also refused to hold a meeting with the leaders of UCPN-Maoist and UDMF to discuss the pending issues concerning a new constitution yesterday and said that they would not hold talks with the Maoists until the cabinet decision on legalizing the actions of the people’s courts and governments is revoked.

Speaking to the reporters after the aborted meeting of the four major power centers such as UCPN-Maoist, NC, CPN-UML and UDMF, Chairman of UCPN-Maoist Prachanda has said that his party has asked the government for providing the opposition leaders with the minutes of the cabinet decision made on this matter to make them clear the essence of the decision.

Opposition leaders particularly of the NC and CPN-UML always opted to show their political muscle disrupting the House session or shutting down the country to vent their anger on any matters they did not like indicating they were not politically matured leaders. If they believe in the rule of law and run the country following the law of the land they need to go to the law court and sort out the problems of irregularities in the cabinet’s decisions rather than disrupting the House session and shutting down the country affecting the lives of the nation, and not holding any meeting with the UCPN-Maoist on the issues concerning a new constitution. They have been ignoring how much loss the nation needs to bear for the disruption of the House session and shutting down the country, and not holding the talks with the Maoists concerning the issues of a new constitution.

An advocate belonging to the Nepal Democratic Lawyers’ Association has rightly filed a case against this cabinet decision at the Supreme Court of Nepal yesterday. The advocate in the case filed at the court has said that the cabinet decision on the proposal submitted by the Ministry of Land Reform goes against its jurisdiction and against the Land Revenue Act, so requested the court for revoking the decision of the cabinet, ‘gorkhapatra’ of today writes. This is the right action against the cabinet decision if we follow the rule of law. NC and CPN-UML leaders need to learn from this action.

These NC and CPN-UML guys have not been serious about the shortage of power, water and petroleum products, have never put pressure on the government to mitigate the shortage rather they have obstructed the government’s decision on building thermal plants for generating power. They never thought about the billions of rupees worth of the loss the nation has been bearing due to the power outage, shortage of petroleum product and shortage of water. These bunch of political guys having everything for their smooth lives have not cared about the people’s suffering caused by the shortage of the three main elements such as power, gasoline and water required for the daily lives of the people, and for their businesses to support the lives.

Other decisions of the cabinet
The cabinet has yesterday decided to provide the schools run in the names of the martyrs killed during the Madheshi movement with Rs 2 million each. Altogether 50 such schools have been operating.

The cabinet also has decided to appoint ambassadors to 10 countries. The names of the ambassadors thus appointed aired by the Radio Nepal in the seven o’clock morning news give the impression that all the names sound to belong to a single ethnic group except for one making the mockery of the inclusion of other ethnic groups in such appointments.

Happy Minister
Minister for Information and Communication Jayaprakash Prasad Gupta has said that the UCPN-Maoist is more favorable to the Madheshi issues than the NC and CPN-UML indicating that the coalition of the UCPN-Maoist and UDMF will be stronger in the future. He also has said that a battalion identifying with the Madheshis will be set up at the Nepal Army; and also said that the NC and CPN-UML are against the autonomy of Madhesh, so it will invite a great movement, ‘gorkhapatra’ of today writes.

Future Governance
In view of the current population and the future growth of the population in Nepal, none of the political parties will be able to govern without the coalition with the Madheshi parties if the Madheshi leaders remain together for fighting the causes of the Madheshi people.
