Finally Comes To An End To CA

May 29, 2012: leaders of four political forces such as UCPN-Maoist, NC, CPN-UML and UDMF have stuck to their stand on state restructuring rather than compromising the issues and give a constitution to the nation. Thus, the Constituent Assembly (CA) has to die at the hands of the political leaders with the political visions on their minds on the midnight of May 27, 2012.

Prime Minister Dr. Baburam Bhattarai has set November 22, 2012 for fresh election to a new CA. In his address to the nation from his official residence at Baluwatar, Prime Minister Bhattarai has put the blame squarely on NC and CPN-UML for the death of the CA, as the NC and CPN-UML leaders failed to agree on promulgating a new constitution through the CA procedures.

In a statement issued from the office of President Dr. Ram Baran Yadav has stated that the Bhattarai government has been a caretaker government after the demise of the CA-cum-parliament. The government will run the general elections on May 22, 2012.

Deputy Prime Minister Ishwor Pokhareal and his colleague left the government in protest. They are both seconded by the CPN-UML. NC representatives in the government had left a few days ago.

On Monday, May 28, 2012, speaking to the reporters at his Lazimpat residence in Kathmandu, Chairman of UCPN-Maoist Prachanda has said that the forces representing the people opting for the status quo have been responsible for the dissolve of the CA, none of the foreign forces has involved in this case.

Speaking at the function held in Kathmandu to celebrate the Fifth Republic Day, Prime Minister Dr. Bhattarai has said that he has no alternative to dissolving the CA, and apologized to the nation for the failure of promulgating a new constitution.

NC, CPN-UML, Rastriya Prajatantra Party, Rastriya Janasakti party and Rastriya Janamorcha strongly protested the government opting for elections without building a consensus on this matter among the parties, and urged the prime minister to quit the office for forming a new consensual government.

NC leader Arjun Nursing KC has said that the government has the strategy of capturing the state power through the elections while in the government, ‘The Rising Nepal’ of today writes. "We are well aware about it and are planning to take to the streets against the ploy of the Maoists," said KC. Meanwhile, the Nepali Congress pronounced the elections to a new Constituent Assembly (CA) declared by the Prime Minister for November 22 was unconstitutional.

CPN-UML leaders jumped on the bandwagon of the NC leaders and said that the declaration of fresh elections was unconstitutional, and it was the ploy of the Bhattarai government to seize the state power through the elections, and they were for removing the Bhattarai government through the constitutional means.

Nepal Federation of Indigenous Nationalities (NEFIN) has supported the government’s decision on holding fresh elections for the Constituent Assembly (CA) after the CA was dissolved without promulgating a new constitution, according to the news on nepalnews.com

Talking to the reporters today, Poor Former Chairman of Constituent Assembly Subash Nemwang has said that the country is heading to a difficult political situation as the political parties failed to listen to his suggestions including the amendment to the Interim Constitution to save the parliament even if the CA gets dissolved according to the news on ‘The Himalayan Times’ of today.

In a joint statement issued in Kathmandu today, 19 political parties including UPCN-Maoist, UDMF and other small political parties said that the government was forced to announce fresh elections for a new Constituent Assembly (CA) following the November-25 ruling of the Supreme Court of Nepal on this matter, the news on ‘The Himalayan Times’ states.

Advocate Santosh Basnet today has filed a writ petition at the Supreme Court of Nepal stating the Prime Minister has dissolved the Constituent Assembly (CA) without delivering constitution in the stated time; it has been unconstitutional; in addition, tens of thousands citizens would not be eligible for casting votes on November 22, 2012, as the sub-clause 7 of the Article 63 of the Interim Constitution states only Nepali citizens of 18 years of age or above on December 15, 2004 could vote according to the news posted on ‘The Himalayan Times’ of today.

Indian leaders belonging to both the ruling party and the opposition have been concerned with the dissolution of the CA without promulgating a new constitution, as it will prolong the political transitional period in Nepal.

UN General Secretary Ban ki-moon has regretted for the death of the CA before promulgating a new constitution.
