Ruling Of Supreme Court Of Nepal On Extension Of Term of Constituent Assembly

November 26, 2011: hearing on the case filed against the extension of the term of the Constituent Assembly (CA) yesterday, the five-member bench of the Supreme Court of Nepal has ruled that the parliament could extend the term of the CA for the maximum of six months only once thereafter the CA would be dissolved automatically.

If the parliament extends the term of the CA for three months then it would be the last extension, thereafter the term of the CA would be automatically ends. So, the Supreme Court of Nepal has forced the parliamentarians to work hard to complete the constitution writing within six months at the maximum otherwise they need to seek fresh mandate from the people.

Originally, they were elected for six months for writing a new constitution and act as parliamentarians until a new parliament is elected but the term of the CA has been extended thrice for one and a half years but they have not completed the writing of a new constitution.

Some legal experts believe that the parliament has just amended the article that has made the provision for the term of the CA. The CA automatically takes a new term after each amendment. So, it is not actually extending the term of the CA but amending the article of the Interim Constitution of Nepal of 2007.
