Reaching A Deal On System Of Governance

May 14, 2012: leaders of three major parties such as UCPN-Maoist, NC and CPN-UML, and the Madheshi alliance called UDMF have reached a deal on the system of governance at the meeting held at the residence of Chairman of UCPN-Maoist Prachanda today. They agreed on the system of governance in which the people will directly elect the president, and the parliament the prime minister. The people will elect the parliament. Then, the parliamentarians elect a prime minister according to the local media report.
How much truth the report has, remains to be seen. The previous report on leaders have reached a deal on 11 provinces has proved to be false. Currently, the local Nepalese media have been reporting that Prime Minister Dr. Baburam Bhattarai has been working on extending the term of the Constituent Assembly that runs out on May 27, 2012. Chairman of UCPN-Maoist, and Prime Minister Dr. Bhattarai have said that the media report on extending the term of Constituent Assembly is false but Prime Minister’s political advisor and UCPN-Maoist politburo member Devendra Poudel said that the prime minister was preparing to extend the tenure of the Constituent Assembly according to ‘The Rising Nepal’ of today. It will soon become clear who is wrong and who is right.
Former Chief Justice Anup Raj Sharma has said that the term of the Constituent Assembly should be extended. He also has said that the ruling of the Supreme Court of Nepal on not allowing the parliament to extend the term of the Constituent Assembly is a mistake according to the Nepalese TV news. “The Supreme Court’s November 25 has unnecessarily interfered with a political question. Therefore, it need not be followed,” the former justice said. “I am free to make my remarks public as a citizen. I am also worried about the future of the country,” he explained, according to ‘The Himalayan Times’ of today.
On November 25, 2011, the Supreme Court of Nepal has ruled that the parliament could extend the term of the Constituent Assembly once for the last time for six months at maximum, and then the term of the Constituent Assembly automatically runs out. Accordingly, the parliament extended the term of the Constituent Assembly for six months until May 27, 2012. It would be dissolved on May 27 even if it fails to deliver a constitution.
