Discussing Modality Of Judiciary

March 28, 2012: politicians and judges have discussed the modality of judiciary in a new constitution at the meeting of the Dispute Resolution Sub-committee held in Kathmandu yesterday; judges have urged the political leaders for making the provision for the independent judiciary following the international norms and values of the judicial system, ‘The Rising Nepal’ of today writes.

During the Rana autocratic family rule, the prime minister held the executive and judicial power. Nepal has separated the executive and judicial power in the mid 1950s. Even after setting up apparently an independent judiciary, the ruling class heavily influenced the judiciary making the judges impossible to function independently.

A telephone call from the palace has been a practice of the ruling class to earn the ruling of the court in their favor in the past currently most of the people in general believe the independent ruling of the court.

The recent ruling of the Supreme Court of Nepal on the abuse of the authority by the former minister has revealed how the judges of the Special Court hearing the case of the minister in question have accepted the bogus evidences for the real ones. The Supreme Court has instructed the Judicial Council to take actions against the judges that have accepted the bogus evidences for acquitting the former minister.
