Government Led By Chief Justice Best Alternative

February 10, 2013: speaking to the reporters in Hetauda yesterday, newly reelected Chairman of UCPN-Maoist Prachanda told the reporters that at the time when a consensus could not be built on anybody for a new government, hoping to reach a consensus on a government led by the sitting Chief Justice, he had put forward the idea of forming a new government headed by the independent personality like the Chief Justice. If the political leaders don’t agree on it then their respect for democracy would be just hypocritical. He said that he did not see any better formula than this one, according to ‘gorkhapatra’ of today.

Speaking to the reporters after the meeting with the head of state at Shital Niwas in Kathmandu yesterday evening chairman of UCPN-Maoist Prachanda said that he had not proposed the formation of a new government headed by the sitting Chief Justice of the Supreme Court of Nepal in the seventh general convention but simply told that it might be the possibility in course of his speech, according to ‘gorkhapatra’ of today.

The idea of Chairman Prachanda to form a new government headed by the Chief Justice of the Supreme Court of Nepal provoked a heated debate among the legal experts and politicians. Some legal experts said that it was the best alternative when a consensus could not reach among the political leaders on a new government but others said that it was another ploy of the UCPN-Maoist to influence the independent judiciary. NC senior leader Sher Bahadur Deuba also said that it would influence the independence of the judiciary.

A senior legal expert called Balkrishna Neupane said that a new CA could not be elected following the Interim Constitution of Nepal; so, the constitution of 1990 should be revived, according to ’gorkhapatra’ of today. The so-called legal expert Mr. Neupane failed to point out where was the provision for reviving the Constitution of Nepal of 1990. Nepal has been suffering from not having the rule of law because of Nepal having such so-called legal experts that could say anything going beyond the legal provisions made in the laws and constitution. Mr. Neupane missed the provision made in the Interim Constitution of Nepal of 2007 for forming any government following the consensus of all political parties.

During a meeting with top leaders of the ruling UCPN-Maoist and Madhesi parties and the opposition NC and CPN-UML yesterday afternoon, President Dr Ram Baran Yadav has said that the lack of agreement among the political parties on finding a common candidate to lead a national unity government has put the prospects of holding elections by May this year in jeopardy. The head of state has reiterated that there is no alternative to a consensus on holding the elections by May and break the protracted political deadlock prevailing in the country. He has called upon political parties to pick a consensus candidate to lead a national consensus government at the earliest as the elections need to be carried out by May at any cost to ensure the much-awaited new constitution, according to nepalnews.com of today.
