Chief Justice A Chairman Of Interim Election Council: A New Turn In Politics

March 14, 2013: after slightly more than a month, the convention of the UCPN-Maoist held in Hetauda from Feb 2-Feb 8, 2013 endorsed the proposal for making the Chief Justice a new prime minister for holding elections to a new CA in June, the head of state President Dr Ram Baran Yadav sworn in Chief Justice Khil Raj Regime as the Chairman of Interim election Council for holding elections to a new CA. Chiarman Regime in turn sworn in two ministers such as Madhav Ghirime as a Home Minister and a Foreign Minister, and Hari Prasad Neupane as a Law and Justice Minister and a Labor and Transport Minister.

After the leaders of four major political parties such as UCPN-Maoist, NC, CPN-UML and UDMF reached an agreement on 11-point understanding, the cabinet headed by Prime Minister Dr Baburam Bhattarai recommended the president to remove obstacles following the Article 158 of the Interim Constitution of Nepal of 2007.

Following the recommendation of the prime minister, the president endorsed the bill on Enforced Disappearance, and Truth and Reconciliation Commission, and sworn in Chief Justice a new prime minister of the Interim government. The four parties agreed on a council of 11 members. The council is entirely for holding elections.

The Nepal Bar Association has said that the CJ-led council is unconstitutional, so the day the Chief Justice has become a chairman of the Interim election Council will be recorded as a black day in the history of the judiciary.

The CPN-Maoist-Viadhya leaders reached the office-cum-residence of the head of state President Dr Ram Baran Yadav while the Chief Justice was sworn in as a Chairman of the Interim Election Council, to protest against the formation of a CJ-led government. Vice-chairman CP Gajurel led the cadres to the office of the president at Maharajgunj to protest. Some cadres shouted, “down with the multi-party panchayat.” Former King Mahendra imposed a no-party system called panchayat in 1962. Mahndra claimed it was a democratic system but it was a dictatorial system that lasted until 1990.

Unexpectedly, the CPN-Maoist-Vaidhya imposed the traffic shutdown from 12:00 noon to 5:00 pm causing untold misery to the passengers that had to wait on the respective buses held on to on the roads for five hours. It was really a madness of the political leaders to abuse the fundamental human rights of the common folks to travel without hindrances. Who are those leaders that ordered to stop traffic on the streets if not criminals that would be bound to ‘The Hague’ for trial one day?

The interim government has directed a committee comprising chief secretary and officials from Home Ministry, Finance, Industry and Commerce to form a committee led by secretaries at Home Ministry, Finance, Industry and Commerce to ease the current short supply of petroleum products and end its scarcity immediately. The cabinet meeting today also decided to immediately stop randomly distributing economic assistance to different organizations. The government said it would not distribute relief and economic assistance, which did not come under the criteria. The government has directed to submit progress reports so far achieved by the concerned ministries so as to bring a future working plan for the present interim government, according to Gorkhapatraonline.com of today.

In a statement issued in New Delhi today, the government of India welcomed the Interim Election Council to find a way out of the ongoing political uncertainty through a consensus even during this juncture of crises and said, “It was a must to hold fresh elections of the Constituent Assembly and establish the hard-achieved gains and multiparty democracy.” India has also expressed its confidence that the new government joining hands with the political forces and the people can meet its goals and hold elections within the slated timeframe through consensus. The government of India will be on the side of Nepali people and support efforts being accelerated to build Nepal into a prosperous nation, and it is ready to extend any kind of aid to Nepal, the statement said, according to the news posted on thehimalayantimes.com of today.

In a news release in Kathmandu today, the US embassy praised the formation of the Interim Council of Ministers for Elections which will lay a foundation for vital further actions including completing and adopting a Nepal’s new constitution and holding free, fair, and inclusive national elections in June, according to thehimalayantimes.com.

Seventeen Central Committee members of the Nepali Congress yesterday submitted a memorandum to party leadership urging it not to accept Chief Justice Khil Raj Regmi as a prime minister without seeking his resignation, according to thehimalayantimes.com.

Meanwhile, Regmi has assumed office as chairman of the Interim Election Council in Singha Durbar today. "I thank political parties for entrusting me with this responsibility. The main objective of the government shall be to conduct free and fair Constituent Assembly elections at the earliest," Regmi said after assuming office, according to the nepalnews.com

A new election government under the Chief Justice Khil Raj Regmi has officially been formed without Prime Minister Baburam Bhattarai announcing his resignation, and Chief Justice Regmi from his office, according to the nepalnews.com.
