Amendment Bill On Judicial Council Submitted To President

December 7, 2012: after the approval of the Amendment Bill on the Judicial Council Act of 1990 by the Council of Ministers, Prime Minister Dr. Baburam Bhattarai took it to the office of the head of state, and submitted it to the President for issuing an amendment ordinance yesterday, according to the state-run news agency RSS.

The Amendment Bill on the Judicial Council is placed under scrutiny according to the President's Press advisor, Rajendra Dahal. A decision on it would be taken only after a thorough study of it, as necessary procedures have to be followed to meet the constitutional and judicial provisions, Dahal told RSS, according to the news posted on thehimalayantimes.com.

Once the president issues an amendment ordinance then justices to the Supreme Court of Nepal could be appointed without the parliamentary hearing in absence of a parliament. Currently, the term of office of several justices is expiring soon. So, an amendment ordinance is urgent need.

On November 21, 2012, a single bench of Justice Sushila Karki issued a show cause notice in the name of the Office of the President to submit explanations in writing in 15 days “for obstructing ordinances sent to President’s office for approval”. The writ was filed by Advocate Udhav Prasad Chaulaghai on Tuesday, November 20, 2012 stating that the President has "illegitimately blocked" the ordinances relating to education, health, and formation of Truth and Reconciliation Commission, according to the news posted on thehimalayantimes.com.
