On May 5, 2009, in the first hearing on the case filed against the President’ action that has bypassed the executive and ordered the Chief of Army Staff (CoAS) to stay on in the job, the single bench of the Supreme Court of Nepal has asked the office of the President to provide the Court with reasons for ordering the CoAS to stay on in the job within ten days.

On May 5, 2009, the police have arrested civil society activists attempting to stage a sit-in protest at the official resident of the president against the President’s unconstitutional action on issuing an order to the CoAS to stay on in the job, and released them after six hours. According to the news in ‘Gorkhapatra’ the Home Ministry has no knowledge of the arrest of the civil society leaders. The civil society leaders have dubbed the president’s action as the ‘Gyanendra Path’.

On May 5, 2009, the State-run news agency ‘RSS’ has stated that the Ramechap District office of the UCPN-Maoist has ordered the leaders and cadres of the NC and CPN-UML to leave the district within five days.
