Ruling Of Supreme Court On Reelection In Bharatpur

KTM Metro Reporter

July 31, 2017

Kathmandu: Hearing on the case of the torn-off ballot papers causing the controversy whether to hold reelection or continue the counting of votes, the Supreme Court of Nepal yesterday ruled to hold reelection in the ward number 19 of the Bharatpur Metro Municipality in Chitwan where the counting of votes was suspended after the representatives of the candidate of the Maoist-Center torn off 90 ballot papers while counting the votes after the second-phase election.

The Election Act has clearly made provision for the reelection if such case happened. It was not the first time such tearing off ballot papers had happened. The CPN-UML representatives had committed the similar crime while counting the votes and when they felt that the NC candidate would win the election. Then, reelection was held.

Even in the second constituencies assembly elections held in 2013, some of the then UCPN-Maoist leaders wanted to scrap some ballot papers making the election invalid but Chairman Prachanda prevented it, said Chairman of Maoists-Center Prachanda while speaking to the reporters for clearing he was not involved in the ballot paper scam in Bharatpur.

After the incident of tearing of ballot papers in Bharatpur, the Election Commission has made the ballot papers were off-limit to the representatives of the political parties while counting votes.

The candidates of CPN-UML and of Maoist-Center were in close contest while counting the votes. The Maoist Center candidate was almost all the time behind by about two thousands votes. Now, the reelection has pleased the Maoist–Center cadres, as chances of getting their candidate get elected improved.
