Hearing On President’s Unconstitutional Move

The state-run newspaper called ‘Gorkhapatra’ of November 12, 2009 has in its news reported that after six months of filling the case, the Supreme Court of Nepal has initiated the hearing on the case filed against the President’s unconstitutional move on directly writing a letter to the Chief of Army Staff fired by the Prime Minister.

Attorneys on behalf of the petitioner have advocated that the President has acted unilaterally on the advice of the leaders of the eighteen political parties without listening to the Prime Minister; so, the President has acted against the principles of the justice; the President has also overstepped the Interim Constitution of Nepal of 2007, as it has no provision for the ceremonial President to do anything without the recommendations of the Prime Minister.
