Consulting With Legal Professional And Constitutional Experts

February 22, 2013: Prime Minister Dr Baburam Bhattarai invited top leaders of major political parties and the legal professionals and constitutional experts to the Singhadurbar Secretariat in Kathmandu yesterday to garner their expert opinions on the formation of a new government led by the serving chief justice. However, members of the Nepal Bar Association (NBA) were not invited to the consulting meeting held by the prime minister. Members of the NBA had submitted a memorandum of protest against forming a new government under the serving Chief Justice a few days ago to the head of state President Dr Ram Baran Yadav.
Most of the lawyers and constitutional experts present in the meeting were the sympathizers of the UCPN-Maoist, CPN-UML, and UDMF. Sympathizers of the NC were conspicuously absent.
Most of the legal and constitutional experts said that it was not proper to form a government under the serving Chief Justice but when the politicians had failed in choosing their common candidate for the office of a new prime minister, choosing the Chief Justice might be the best option; and the constitution did not prevent them from doing so.
Some of the experts suggested that the political leaders should agree on all modalities of the elections before forming a new government, and all political parties need to agree on forming a new government headed by the serving chief justice.
However, some small communist parties including CPN-Maoist-III (Vaidhya) were against forming a new government under the chief justice. Even majority of the NC CWC members and some members of the CPN-UML were against forming a government under the chief justice. Some of the Madheshi parties also were against such a government.
Chief Justice Khil Raj Regmi has been reluctant to accept the offer of the office of prime minister without a consensus on forming such a government. So, he has not said, “yes” to lead such a government, yet.
