Head Of State Summons Political Parties To Form A Unity Government

November 23, 2012: in a press statement issued by the Office of the President said the Head of State exercising the authority given by the Article 36 (A) of the Interim Constitution, President Dr. Ram Baran Yadav summoned the political parties to find out a new candidate for the office of prime minister by November 29, 2012 following the Article 38 (1) of the same constitution.

Article 36A. President: (1) There shall be a President in Nepal.

(2) The President shall be the head of state of the country, and in that capacity perform his or her functions in accordance with this Constitution and the laws in force.

(3) The main duty of the President shall be to protect and abide by this Constitution. 

Article 38. Formulation of Council of Ministers: (1) The Council of Ministers shall be formed under the chairpersonship of the Prime Minister, on the basis of political understanding.

Officials at the Office of the President described the latest step as a result of the political developments in the past five months. Rajendra Dahal, Press Adviser to the President, told THT that the move is part of the ongoing process and that the Head of State has not taken into consideration whether parties will be dissatisfied, according to THT ONLINE news.

“The government and the party leading the government have come to the conclusion that the President’s move is unconstitutional,” said Devendra Poudel, chief political adviser to Prime Minister Bhattarai, “The government and the party will, however, make their official stances public tomorrow,” according to THT ONLINE news. 

NC and CPN-UML leaders welcomed the President’s call for finding out a consensus candidate for the office of prime minister within seven days but it remains to be seen whether they will be able to find a consensus candidate.
