Interference Of Supreme Court In Business Of Constituent Assembly

Issue 49, December 4, 2011

By KTM Metro Reporter

December 1, 2011: speaking at the House session yesterday, one of the leaders of UCPN-Maoist Amik Sherchan has said that the ruling of the Supreme Court of Nepal on the extension of the term of the Constituent Assembly has been unconstitutional, as the Supreme Court has failed to state the Article of the Interim Constitution of Nepal of 2007; this ruling has been dictatorial and has been against the ongoing peace process and the crafting of a new constitution; so, it is not acceptable, ‘gorkhapatra’ of today writes.

As the ruling of the Supreme Court of Nepal on the extension of the term of the Constituent Assembly is unconstitutional, the parliament could  start a move on the impeachment of the justices that have over stepped the Constitution, ‘The Rising Nepal’ of today quotes Amik Sherchan.

Speaking at the same House session, leader of CPN-UML Dhirendrabahadur Shrestha has said that the ruling of the Supreme Court of Nepal on the extension of the term of the Constituent Assembly has been to hold back the peace process and the constitution writing; the Constituent Assembly also is the parliament that makes laws so the Supreme Court needs not instruct it on this matter, as there is no provision on the law for this matter, ‘gorkhapatra’ of today writes.
