Recommending Joshi For Chief Justice

Kathmandu: The Constitutional Council Prime Minister KP Oli presided over chose senior most justice and acting chief justice Deepak Raj Joshi from among the three justices the Judicial Council has recommended for the position of the Chief Justice of the Supreme Court of Nepal, the news in “gorkhapatra” on June 13, 2018 stated.
Joshi has been acting chief justice since former Chief Justice Gopal Parajuli was forced out of office on March 15, 2018. In absence of a parliamentary hearing committee, none of the vacant positions of the chief of constitutional bodies could be filled up.
The House of Representatives needed to pass the House Regulations for setting up the parliamentary hearing committee for hearing on the recommended candidate for the position of the Supreme Court of Nepal.
The main opposition parties NC and Rastriya Janata party have stalled the House Regulations at the House demanding to delete the word “suspension” of lawmakers who even commit crimes such as rape, murder and robbery. Ultimately they came out victorious only recently opening up the way to set up a parliamentary hearing committee.
However, the House has yet to set up the parliamentary hearing committee for hearing on candidate Joshi and then endorse his candidacy so that the president could appoint him to the position of the Chief justice of the Supreme Court. It might be a few more weeks before Joshi could be a full-fledged Chief Justice. He would have 16 months to go before he would get retirement based on the age limit on the position of the chief justice.
