Petition Against Promotion of Toran Singh

On December 27, 2009, claiming the current government headed by Madhav Nepal has promoted Toran Jung Bahadur Singh to Lieutenant General and Second-in-command of the Nepal Army going against the values and principles of the democracy and the rule of law, Central Committee Member UCPN-Maoist Krishna KC, Maoist cadres Himal Sharma and Bina Magar have filed a joint application at the Supreme Court of Nepal challenging the cabinet decision on promoting Singh.

The national and International human rights organizations have been urging the government of Nepal for charging Toran Jung Bahadur Singh with the criminal act of enforced disappearance of 49 people from the custody of the Bhairavnath Battalion. The United Nations Office of High Commissioner for Human Rights (UNOHCHR) has indicted Toran Jung Bahadur Singh for the enforced disappearance of 49 people while he was the commander of the Bhairavnath Battalion.

The petitioners have made Prime Minister's office and cabinet, Minister of Defense Bidhya Bhandari, Army Headquarters, Lt Colonel Singh and the promotion committee of Ram Chandra Man Singh, Home Secretary Dr Govinda Kusum, and Defense Secretary Nabin Ghimire defendants in the petition.

Claiming the promotion of Toran Jung Bahadur Singh is not following the rule of law and the Civil Rights Act of 1955, the petitioners have urged the Supreme Court of Nepal to quash the government's decision on promoting him, and sought the stay order of the Supreme Court of Nepal not to enforce the decision of the cabinet.
