Supreme Court Orders To Release Chudamani Sharma

Kathmandu: on August 11, 2017, hearing on the habeas corpus filed by the wife of Chudamani Sharma, a full bench comprising justices such as Deepak Raj Joshi, Deepak Kumar Karki, Kedar Prasad Chalese, Sharda Prasad Ghimire, and Anil Kumar Sinha of the Supreme Court has ordered to release Director General of Inland Revenue Office Chudamani Sharma suspended for the largest possible corruption case on general date to appear in the court.
Commission on Investigation into Abuse of Authority (CIAA) had taken Sharma in custody, and conducted an intensive investigation into the abuse of authority for waiving taxes, and filed a corruption case against Sharma and his two accomplices still on the run at the Special Court demanding the bail amount of NPR 10 billion, and had kept him in its custody.
Hearing on the habeas corpus, one of the previous benches had order to keep Sharma under the police rather than in the CIAA custody. One bench after another had been postponing the ruling on the habeas corpus keeping Sharma in the police custody for more than two months.
The latest full bench has also ruled that the Tax Redemption Commission of which Sharma was the member secretary as a semi-legal body easing the Special Court, and opened up the door for the Special court to hear on the corruption allegedly Sharma and his two accomplices had committed. The Supreme Court had suspended the corruption case against Sharma at the Special court until the ruling on the habeas corpus was completed.
The Supreme Court has left the Special Court to rule whether the husband of the petitioner as a member of Tax Redemption Commission set up with the special power had performed the duty with good intention or not.
