Motion To Impeach The Chief Justice

Kathmandu: May 1, 2017, the lawmakers belonging to the coalition partners in the government have introduced the motion to impeach the Chief Justice of the Supreme Court of Nepal at the parliament on April 30, 2017 leading the automatic suspension of the Chief Justice.

 

This is one of the democratic exercises in Nepal to indicate nobody is above the law. The rulers have heavily influenced the judiciary in the past. The judges had always read the wishes of the rulers before making any judgment in the past.

 

For example, in 1995 when the then Prime Minister Manmohan Adhikari dissolved the parliament and called for general elections, the opposition NC party went to the Supreme Court seeking to block the actions of the prime minister. The then Chief Justice Biswonath Prasad Upadhaya did what the NC wanted interfering in the prerogative of the prime minister and ultimately causing the political chaos thereafter.

 

Some political analysts said that the currently suspended Chief Justice Sushila Karki had been heading to the direction of the Upadhaya of 1995, for creating a political chaos giving the political verdicts. The impeachment proposal has effectively stopped her from doing any such kinds of negative judgment, the analysts said.

 

Sushila Karki has slightly more than a month before retiring from the Chief Justice. So, whether the parliament passes or not the motion to impeach the chief justice; Sushila Karki might not return to her job, as the lawmakers would simply linger over the motion until her retirement.
