Min Bahadur Rayamajhi For Chief Justice

On April 29, 2009, the meeting of the Constitutional Council presided over by Prime Minister Prachanda has selected Justice Min Bahadur Rayamajhi for the position of the Chief Justice of the Supreme Court of Nepal based on the seniority and a number of years of service at the Supreme Court of Nepal.

Judicial Council has recommended six justices such as Min Bahadur Rayamajhi, Anupraj Sharma, Ram Prasad Shrestha, Khilraj Regime, Balaram KC and Top Bahadur Magar for the position of the Chief Justice of the Supreme Court of Nepal based on the minimum three-year service at the Supreme Court.

Justice Rayamajhi has to go through the parliamentary hearing before he gets an appointment from the President on the recommendation of the Constitutional Council.

Some law professionals have charged Justice Rayamajhi of hearing a case that he should not have heard of it, as he was previously involved in it.

Current Chief Justice Kedar Prasad Giri is retiring on May 03, 2009 based on the age limit. The law has the provision for the compulsory retirement of Chief Justice at the age of 65 year.

If Justice Rayamajhi were appointed to the position of the Chief Justice of the Supreme Court of Nepal, he would have seven months to serve before reaching the age limit for retirement.
