Rule Of Law And Celebration Of Loktantra Day

April 25, 2010: the four crook political celebrities such as President Dr. Ram Baran Yadav, Vice-president Permananda Jha, Prime Minister Madhav Nepal and Speaker Subash Nemwang dressed in the Panchayat era uniform set for such high dignitaries standing at the Nepal Army pavilion in Tundikhel, Kathmandu in celebration of Loktantra Day on April 24, 2010, and taking a look at various shows demonstrated by the possibly hired groups of performers are certainly the reminiscent of the Panchayat era celebration of Democracy Day.

We can draw a parallel between the current celebration of Loktantra Day and the celebration of Democracy Day during the Panchayat Era. The then Panchayat rulers had made the mockery of democracy celebrating the Democracy Day at the same time holding democracy hostage. Today, those four unscrupulous rulers celebrating the Loktantra Day at the same time holding Loktantra hostage have made the mockery of Loktantra.

If Loktantra is the rule of law, then these four guys that have violated the Interim Constitution of Nepal of 2007 have no rights to celebrate the Loktantra Day.

The first elected President of Federal Democratic Republic of Nepal Dr. Ram Baran Yadav has abused the Interim Constitution of Nepal of 2007 directly writing a letter to the then army chief and ordering him to stay on the job overstepping the decision of the then elected Prime Minster on firing the army chief for his undisciplined activities. The ceremonial President can act only on the recommendation of the Prime Minister but Dr. Yadav as a President has acted as an executive abusing his position of the ceremonial status.

Vice-president Permananda Jha has abused the Interim Constitution of Nepal of 2007 even at the time of taking the oath of office. Mr. Jha took the oath of office of the Vice-president in Hindi even though the President was giving it in Nepali. Mr. Jha got punished for taking the oath of office in Hindi and had remained suspended until the legislature amended the Interim Constitution of Nepal of 2007 for making the provision for taking the oath of office in his/her mother tongue of the elected officials.

Prime Minister Madhav Nepal is an illegitimate child of the legislature made legitimate by the family of the 22 unscrupulous political parties. In the name of the majority rule, these 22 political parties have been holding Loktantra, promulgation of a new constitution and the peace process hostage. They have been least concerned with the promulgation of a new constitution and the peace process but concerned with going head-on confrontation with the opposition.

Naturally, Prime Minister Madhav Nepal has been as an unbridled horse with the support of the unprincipled family of the 22 political parties to run the state administration. So, he has broken any past records of not following the rule of law and for amassing wealth. He has amassed such huge wealth most probably enough for arming the Youth Force to fight against any opposition Mr. Nepal faces.

Finally, Speaker Subash Nemwang has abused the basic principle of the rule of law not allowing the debate over the President’s unconstitutional move on directly writing a letter to the then army chief at the legislature. Mr. Nemwang as the Chairman of the Constituent Assembly has been a failure in writing a new constitution, as the deadline of completing the writing of a new constitution has been coming closer every day but the Constituent Assembly has not been able to do anything. So, Mr. Nemwang unable to do anything to completing the writing of a new constitution needs to quit his position of the Chairman of the Constitution Assembly immediately.

So, all these four unprincipled political celebrities wearing the Panchayat era uniform and celebrating the Loktantra Day on April 24, 2010 at the same time holding Loktantra hostage reminds us the Panchayat era celebration of the Democracy Day.
