Acting Chief Justice Damodarprasad Sharma

March 15, 2013: immediately after the chief justice took the oat of the office of the Chairman of the Interim Election Council, the office of the chief justice became vacant yesterday; immediately, the senior-most justice of the Supreme Court of Nepal Damodarprasad Sharma took over the office of the Chief Justice following the Article 103 of the Interim Constitution of Nepal of 2007. He has started off the administration of the Supreme Court of Nepal, according to the ‘gorkhapatra’ news of today.

Acting Chief Justice Sharma took the office of the Chairman of Judicial Council, and made Justice Ramkumarprasad Shah the member of the Judicial Council responsible for appointment, transfer, and firing of judges.

The Special Bench of Ramkumarprasad Shah, Girishchandra Lal, and Sushila Karki was supposed to hold hearings on the cases filed by Bharat Jangum and Advocate Ompraksh Aryal against the formation of the government presided over by the Chief Justice yesterday but it was deferred, as Ramkumarprasad Shah became the member of the Judicial council, and the petitioners had made the Judicial council as a defendant; so, Justice Ramkumarprasad Shah cold not take up the cases and postponed for other day.

At the same time, Advocate Omprakash Aryal has register another case against the amendment to the Interim Constitution of Nepal of 2007 following the Article 158, and then making the chief Justice the Chairman of the Interim Election council stating both are unconstitutional, and the Chief Justice cannot hold any offices other than the judicial, according to the ‘gorkhapatra’ news of today.
