Writing A New Constitution

February 1, 2011: the Constitutional Committee (CC) assigned to prepare a draft constitution has made a decision in its meeting held on Monday, Jan 31, 2011 on preparing a unified draft report of the new constitution starting from the subject matters that the political parties have already agreed on, ‘The Rising Nepal’ of Feb 1 writes.

The CC has been dormant for almost eight months due to the political parties not moving forward to building a consensus on the contentious issues appeared in the reports prepared by different thematic committees on a new constitution.

Following the provision made in the Interim Constitution, the CC needs to prepare a unified draft of the new constitution based on the subject matter reports prepared by all thematic committees.

Chairman of CC Nilamber Acharya has said that the CC will hold regular meetings from today onward to work on the reports of the CA thematic committee on System of Governance; in addition, the CC has initiated to prepare the unified draft on the reports of different thematic committees of the CA holding discussion on unresolved issues for settling the differences; the CC has also already held discussion with the political parties and some legal experts in preparation to drafting a preliminary draft of the new constitution after it received the reports of ten thematic committees.

At the same time, secretary to UCPN-Maoist CP Gajurel ‘Gaurav’ has said that his party is for completing the peace process and the constitution writing no matter whether his party will lead a new government or sits in the opposition. He, however, warned of a people’s revolt if the reactionary and status quo forces obstruct the peace process and the writing of a new constitution. He has explained that the people’s revolt is just an alternative means to achieve the goal of peace and a new constitution if the current process fails in yielding any result, ‘The Rising Nepal’ writes. The Constituent Assembly is supposed to promulgate a new constitution by May 28, 2011.
