Nepalese President Calls On the Parliament To Elect Prime Minister

August 25, 2011: after the expiry of the extended time for building a consensus on a new government on Wednesday following the article 38 (1) of the Interim Constitution of Nepal of 2007, the president has called on the parliament to elect a new prime minister following the Article 38 (2).

Prime Minister Jhalanath Khanal had resigned from the office on August 14 not being able to do anything to complete the peace process and the constitution writing but blamed the UCPN-Maoist and the NC for his failure.

NC has withdrawn the candidate of Sher Bahadur Deuba for the office of prime minister after Deuba could not build a consensus on forming an all-party coalition government. Now, NC has put forward its parliamentary party leader Ram Chandra Poudel as the candidate for the office of prime minister for the election following the article 38 (2) of the Interim Constitution of Nepal of 2007.

UCPN-Maoist has already announced that its candidate Dr. Baburam Bhattarai will remain the candidate for the office of prime minister in the election to be held following the Article 38 (2) of the Interim Constitution of Nepal of 2007.

Practically, we will have two main candidates: Dr. Bhattarai of the UCPN-Maoist and Mr. Poudel of the NC for the office of prime minister.

This time, we will not have a number of rounds of elections to a new prime minister as in the past, as the parliament has amended the rules of the parliamentary election to a prime minister. Elections might be held three times at maximum.

Following the amended rules, any candidates need to have majority votes for getting the office of prime minister even if s/he is a single candidate. If none of the candidate can garner the majority in the first round of the election, then the Speaker will submit the same candidates for the second round of the elections. If none of them could garner majority votes in the second round of the election, the first two candidates that have received highest votes will contest in the third round of the elections. If none of then could receive majority votes, the process for the elections ends there.
