Vice-president’s Oath in Hindi Unconstitutional

On July 24, 2009, the Supreme Court Bench comprising Chief Justice Minbahadur Rayamajhi and Justice Balaram KC has ruled that the Vice-president’s oath in Hindi is unconstitutional, as it goes against the Clause 36 (i) (2) and Annex-1 (a) of the Interim Constitution of Nepal of 2007. The ruling says that the oath taken by Vice-president on July 23, 2008 is annulled.

Taking oath in Hindi, Vice-president Permananda Jha had provoked the Nepalis to stage protest rallies against him a year ago. After a year the Supreme Court has ultimately ruled the Vice-president’s oath in Hindi is unconstitutional.

The Supreme Court has another pending burning case to rule is the case of the ceremonial President’s action of directly writing a letter to the Chief of Army Staff ordering him to stay on in the job. The Supreme Court needs to act fast on its case, too.
