Supreme Court Annuls Law Suit Against President

October 1, 2010: A panel of Supreme Court justices such as Top Bahadur Magar, Prem Sharma and Mohan Prasad Sitaula has ruled that the case filed against the President for directly writing a letter to the then Chief of Staff in May 2009 has been irrelevant as the Nepal Army Act has been amended and the Executive has taken the appropriate actions on it. Thus, the justices have avoided saying whether the President has abused the Interim Constitution of Nepal of 2007, and have tried not to interfere in the politics of Nepal. However, it is a clear signal to the President to use his discretion bypassing the Prime Minister. It is a threat to the democracy as the President might impose his rule and come out as a dictator as Chairman of Nepal Workers’ and Peasants’ Party Narayan Man Bikuckchhe wants. We have to watch and see how this ruling of the Supreme Court of Nepal will directly impact on the current political deadlock. We also need to note why the Supreme Court has taken such a long time to decide this case while the Supreme Court of Nepal has given its ruling on the case of Vice-president using Hindi for taking oath of his office within a few weeks.
