EC Sent RPP Back To Election Commission

Kathmandu: Hearing on the petition chairman of Rastriya Prjatantra Party (RPP) Kamal Thapa filed at the Supreme Court, a single bench of the Supreme Court ruled on September 1, 2017 to send back the case of Thapa demanding a new party RPP-democratic the Election Commission had registered following the ruling of the Supreme Court to annul it as some of the signatures were fake, to the Election Commission to sort out the problem of dispute between the two RPPs, the seven O’clock morning news in the Radio Nepal stated today.

 

The Election Commission had asked the leader of the breakaway party RPP-democratic Pashupati Shumsher for bringing the signatories to verify their signatories for registering a new party but first Pashupati Shumsher requested time extension for bringing those lawmakers for the verification of their signatories, and then he went to the Supreme Court for ordering the Election Commission to register his new party as he had met all the obligations the prevailing law required. The Supreme Court rule in his favor and the Election Commission registered the new RPP-democratic.

 

Following the law, any dissident groups needed at least 40 percent of the central committee members. Chairman Thapa had appointed 42 new members to the central committee of the RPP that was the beginning of setting up a new breakaway party, as Thapa failed in even informing Pashupati Shumsher not to mention consulting with him. The total number of RPP central members is 156. So, Pashupati Shumsher needed 63 members to make it 40 percent.

 

The Election Commission had made a decision on verifying the signatories of lawmakers that wanted to set up a new RPP-democratic obviously not required by the law. This is what usually the bureaucrats did and do even today for various purposes making the service seekers trouble.

 

Dumping the burden of proof for finding out who is right and who is wrong on the Election Commission, the Supreme Court has shown its independence and its maturity in ruling.
