NBA’s Objection To Chief Justice’s Acceptance Of Leading A Government

February 27, 2013: after the Chief Justice Khila Raj Regime formally accepted the office of a new government, the Nepal Bar Association (NBA) has seriously objected to it. Members of NBA held an emergency meeting of the NBA advisory Committee to discuss the statement of the Chief Justice released by the Supreme Court of Nepal stating the Chief Justice was ready to head a new government for holding the elections to a new CA, according to the ‘gorkhapatra’ news of today.
The NBA members concluded that once the Chief Justice accepted to head a new government means he is the candidate for the office of the prime minister, he could not morally preside over any legal proceedings. The Chief Justice participating in the meeting of the political parties, and accepting the office of the government has made a mockery of the judiciary, and in addition, he went against the code of conduct of justices; so, the Chief Justice has no moral rights to remain in the judicial service.
NBA has regretted that the Supreme Court of Nepal has released a statement that has said that the chief Justice has accepted the office of a new government adversely affecting the writ filed against such a government at the Supreme Court of Nepal
Making the chief Justice a new prime minister is unconstitutional, so, NBA has requested the political parties not to indulge in such unconstitutional activities.
At an informal meeting of the members of the central committee of NC held at the Maharajgunj residence of President of NC Sushil Koirala yesterday, they urged the NC president to rethink the approval of making the Chief Justice a new prime minister, as it goes against the constitution, and the democratic norms and values, according to the ‘gorkhapatra’ news of today.
At the meeting held yesterday, leaders of CPN-UML have had hot discussions on making the Chief Justice a new prime minister. Some leaders were for making the chief Justice a prime minister while others did not like the idea, according to the ‘gorkhapatra’ news of today.
