Reinstatement of Chief Justice in Pakistan

Issue 12, March 22, 2009

By Kathmandu Metro Reporter in Kathmandu

On March 16, 2009, the Pakistani government announced the reinstatement of Chief Justice Iftikhar Chaudhry fired by deposed former Military Ruler Pervez Musharraf to avoid the direct confrontation with the thousands of protestors mobilized by Former Prime Minister Nawaz Sharif. This was seen as the victory of democracy in Pakistan.

Current President Zardari and Former Prime Minister Nawaz Sharif jointly wanted to finish off Military Ruler Pervez Musharraf; so, they reached an agreement on many things to do after the removal of Musharraf, one of them was to reinstate the judges including the Chief Justice of the Supreme Court of Pakistan.

President Zardari reinstated several judges; however, he did not do so to the chief justice for fear of opening the corruption cases against him. Mr. Zardari had spent 11 years in jail for corruption. One of the corruption cases was still pending in the court of Switzerland.

Most of the Military Generals had removed the civil elected governments in Pakistan in the past on the pretext of they being corrupt. However, military rulers became more corrupt than the civil rulers. So, they did not last long, too.

The reinstatement of Chief Justice Iftikhar Chaudhry would make the judiciary independent and would be the threat to the corrupt politicians. During the Musharraf regime, Chief Justice Iftikhar Chaudhry became the main threat to his despotic rule. So, he manipulated the judiciary and fired the chief justice to continue his dictatorial rule.
