Provision for Hiring and Firing of Judges

On August 27, 2009, the Constitutional Committee on Judiciary has passed that the legislature will be responsible for hiring and firing of judges according to the state-run-newspaper ‘Gorkhapata’ of August 28, 2009. The Judicial Committee comprising Chief Justice as the chairperson, one senior justice of the Supreme Court, Minister for Justice, one legal expert appointed by the Prime Minister and one representatives of the Nepal Bar Association as the members has been responsible for hiring and firing of judges so far following the provision made in the constitution.

Members of the Constitutional Committee on Judiciary belonging to the United Communist Party of Nepal-Maoist, Madheshi People’s Rights Forum, Tarai Madhesh Democratic Party, Madheshi People’s Rights Forum-Democratic, Nepal Sadbhavana Party and other small parties voted for the proposal for making a legislature responsible for hiring and firing of judges whereas the members belonging to Nepali Congress, Communist Party of Nepal-Unified Marxist and Leninist, and Nepal Rastriya Prajatantra Party-Nepal have voted against it. Twenty-three members voted for it and nineteen against it.
