Supreme Court Issues ‘A Stay Of Enforcing BIPPA’

November 29, 2011: hearing on the case filed against the Bilateral Investment Promotion and Protection Agreement (BIPPA) Nepal has reached with India during the visit of Nepalese Prime Minister Dr. Baburam Bhattarai to India, the Supreme Court of Nepal has issued ‘a stay of enforcing’ the article 15 of the BIPPA until the parliament endorses it following the Article 156 of the Interim Constitution of Nepal of 2007 or until the verdict on this case is given.
Following the article 15 of the BIPPA, the two signatory countries need to exchange the information about enforcing the agreement.
Following the Article 156 of the Interim Constitution of Nepal of 2007, the government of Nepal needs to get the BIPPA ratified by the parliament before enforcing it.
Nepalese Finance Minister Barsha Man Pun and his Indian counterpart Pranab Mukherjee had signed off the BIPPA in New Delhi on October 21, 2011 during the Prime Minister Baburam Bhattarai's visit to India.
