Prime Minister Koirala’s Reply to Supreme Court

On Friday, April 04, 2008, in a reply given in writing to the Supreme Court’s notice concerning the case challenging the third amendment to the Interim Constitution, Prime Minister Girija Prasad Koirala said, “The third amendment to the Interim Constitution of 2007 has made a provision for the implementation of the agenda for republic by the first meeting of the CA.” “Since the provision made for the implementation of the agenda is based on the decision of the first CA meeting pursuant to the Article 159 (2) of the Interim Constitution, there is no need for the Apex Court’s intervention on the issue,” the Prime Minister said. “Pursuant to the Article 107 of the Interim Constitution, the amendment is the exclusive right of the legislature and thus the Supreme Court cannot review it,” he added. Advocate Achyut Prasad Kharel challenged the third amendment to the Interim Constitution in the Supreme Court according to the report of ‘The Himalayan Times’ of April 04, 2008.
