Issue 21, May 24, 2009

By KTM Metro Reporter in Kathmandu

Hearing the case filed at the Supreme Court of Nepal against the unconstitutional act of the President directly writing a letter to the Chief of Army Staff, giving the deadline of 10 days for reply, the Supreme Court of Nepal has asked the Office of the President the reasons for the President writing a letter directly to the Chief of Army Staff and ordering him to stay on in the job. According to the ‘Gorkhapatra’ of May 18, 2009, the President’s office has sent the explanations to the Supreme Court stating the President has taken the actions in view of the request of the majority of the political parties represented in the parliament and of the political situation in the country; in addition, the President’s action is not entirely based on the legal and constitutional matters but on national security, legal and peace, and the sensitivity of the army.
