A Lawsuit Against Promotion Of Colonel Raju Basnet

October 15, 2012: Rupa Maharjan of Kathmandu and legal practitioner Bidur Prasad Adhikari filed a writ petition at the Supreme Court of Nepal making the Office of the Prime Minister and Council of Ministers, Defense Ministry, NHRC, Nepal Army headquarters and Brigadier General Basnet the defendants, and demanding to annul the promotion of Nepali Army colonel Raju Basnet to Brigadier General, as he was allegedly involved in the enforced disappearance of 49 Maoists held in custody at the Bhairabnath Battalion at Maharajgunj when he was commanding the battalion in 2003 according to RSS/thehimalayantimes.com.

The petitioners urged the Supreme Court of Nepal to issue a directive to the government to enforce the Article 132 of the Interim Constitution of Nepal of 2007, as recommendations made by the National Human Rights Commission (NHRC) to the government were not enforced frequently violating the Article instead of its enforcement.

The government promoted Colonel Basnet to Brigadier General on October 4, 2012 ignoring the protests of the international and local human rights activists and organizations, and the loved ones of the victims of the enforced disappearance.

The Supreme Court of Nepal today issued a stay order on the decision the government made on promoting Colonel Raju Basnet to the Brigadier General of Nepali Army. The government promoted him by the decision of the Cabinet made on October 4, 2012 following the recommendation made by the Nepal Army, writes ‘THT ONLINE’.
