Correct ‘Removing Constitutional Hurdles Ordinance’ Says MPRF-Nepal

Issue 15, April 14, 2013

By KTM Metro Reporter

April 11, 2013: Madhesi People’s Rights Forum-Nepal (MPRF-Nepal) held a news conference in Kathmandu yesterday to brief the reporters the decisions made by its two-day central committee meeting concluded on Tuesday, April 9, 2013, according to the RSS news posted on thehimalayantimes.com yesterday.

The ordinances issued in the name of removing obstacles are done in an unconstitutional and undemocratic way, so these ordinances should be corrected through an all-party consensus, says MPRF-Nepal.

The MPRF-Nepal stated that the environment conducive to holding fresh Constituent Assembly (CA) elections should be made building a consensus on the basic principles of Federal Democratic Republic Nepal that is to be established through the CA. Chairman of the MPRF-Nepal Upendra Yadav said that the CA elections held without making the nature of the Constitution clear would make no sense at all.

The MPRF-Nepal also suggested that Chairman of the Interim Election Council of Ministers should quit one of the two offices: either the office of Chief Justice or of the Chairman of IECM, as holding both the positions was against the democratic norms and values, separation of powers, balance of power, and concept of independence of judiciary.

The MPRF-Nepal also concerned with the decrease in the proportional representation in the CA. It is an attempt on minimizing the representation of the Madhesis, indigenous nationality, Dalits, women, Tharu, Muslim and marginalized communities, and that the latest decision on this matter should be annulled says MPRF-Nepal.
