Shame On The Government For Withdrawing Murder Case
By KTM Metro Reporter
December 31, 2012: hearing on the writ petition filed by Khushilal Shah stating that the Cabinet had withdrawn the murder case pending at the Siraha District Court against 13 people accused of killing Shah’s father Bholahi on August 2, 2010, the Supreme Court today issued the stay order on the December-6 cabinet decision on withdrawing the murder case, according to ‘HIMALAYAN NEWS SERVICE’ news of today.
A single bench of Justice Damodar Prasad Sharma issued the stay order following the today’s hearing, and stated in the order that the Cabinet decision was against the precedent the Supreme Court of Nepal has made by its ruling on not withdrawing the murder cases; consequently, the Cabinet decision taken on December 6 was against the precedent; the government should not withdraw the murder case pending at the Siraha District Court.
If the government is really for the rule of law, the government needs to bring the perpetrators of murder of Bholahi to justice rather than letting them go free with impunity withdrawing the murder case filed against them.
