Formation of New Government

On May 11, 2009, for blocking the election for a new Prime Minister, the United Communist Party of Nepal-Maoist (UCPN-Maoist) has decided continuing to stop the parliamentary session until the President rectify his unconstitutional act of writing a letter to the Chief of Army Staff (CoAS) bypassing the elected government, and stage rallies throughout the country against the President’s unconstitutional step.

Madheshi People’s Rights Forum (MPRF) leaders have said that they will support the Communist Party of Nepal-Unified Marxist and Leninist (CPN-UML) leaders for forming a new government if the CPN-UML leaders commit to support the Madheshi concerns in writing.

Talking to the anchor of the morning program called ‘Antar Sambad’ of the State-run Radio Nepal, the Speaker has said that the current need is for the consensus politics, and all political parties need to sit together and remove the current political standoff following the consensus politics to pave the way for forming a new government.

Independent political analysts say that if the parliament elects Madhav Kumar Nepal rejected by the voters, it will be the violation of the suzerainty of the people and if the President appoints him to the position of Prime Minister it will be the another violation of the suzerainty of people if the suzerainty of people means the rule by the elected people’s representatives.

The CPN-UML leaders have already shown their moral bankruptcy appointing Madhav Kumar Nepal defeated in two constituencies in the election for a Constituent Assembly held in April 2008, to the member of the parliament based on the proportional representation system.

In addition, political parties attempting to form a new government without rectifying the President’s unconstitutional act will set the precedent of the President reserving the rights to overstep on the decisions of the elected government and risk the possibility of even dismissal of an elected government in the name of defending the Constitution, as the precedent will give the President the rights to do so in the name of defending the Constitution. So-called constitutional experts have ignored these facts and support the unconstitutional act of the current President.
