Issue 36, September 05, 2010

By KTM Metro Reporter

September 2, 2010: the bench of Chief Judge Gauri Bahadur Karki and Judges Om Prakash Mishra and Kedar Prasad Chalise of the Special Court has convicted former General Manager Madan Raj Sharma of the state-run oil company called Nepal Oil Corporation (NOC) of corruption today. The bench has ruled that Mr. Sharma has amassed Rs 20.2 million abusing the power while in the office, and has ordered the government to freeze the bank accounts and properties of Mr. Sharma, his wife and daughter, and sent him to jail for a year after recovering the amount of money he has illegally amassed.

Commission on Investigation into Abuse of Authority (CIAA) has filed a case against Mr. Sharma in March 2004. Mr. Sharma can appeal at the Supreme Court of Nepal that may either uphold the decision of the Special Court or overturn it.

Similarly, the Special Court had sentenced and fined former Governor of Central Bank called Nepal Rastra Bank Bijyanath Bhattarai for corruption but the Supreme Court of Nepal overturned the ruling of the Special Court and acquitted him. Prime Minister Madhav Nepal has reinstated him to the position of governor again in February 2010.
