Prachanda Rejects Invitation To Constitutional Council Meeting

October 30, 2010: Stating the invitation has been sent without consulting him, Chairman of UCPN-Maoist Prachanda has refused to accept the invitation sent on Saturday, October 30, 2010 by the Office of the Prime Minister and the Council of Ministers (OPMCM) to a meeting of the Constitutional Council (CC) meeting to be held on Sunday, October 31, 2010, nepalnews.com writes quoting Kantipur and Nagarik newspapers that in turn have reported quoting anonymous sources. Following the provision made in the rules and regulations concerning CC, the chairperson needs to send an invitation to all members to a meeting 48 hours before the meeting is held. Meetings cannot be held without the presence of the leader of the opposition party.

The Supreme Court of Nepal has annulled nominations made by the CC on April 23 in absence of the opposition leader Prachanda stating the meeting held without the presence of the opposition leader has been faulty. Opposition leader Prachanda did not attend the meeting stating the CC has not invited him 48 hours before the meeting; in other words, the CC has not followed the rule of law.

Prime Minister chairs the CC. Members of the CC are Speaker of the House, Chief Justice of the Supreme Court of Nepal, and the leader of the main opposition party. The main job of the CC is to appoint persons to various vacant positions at the constitutional bodies such as Commission on Investigation into Abuse of Authority, Public Service Commission, Office of Attorney General, and Election Commission. Because of the faulty business of Officiating Prime Minister Madhav Nepal, the CC has not been able to do its business and fill up the vacant positions at the constitutional bodies.
