Prime Minister’s Attempt To Defy Law

January 21, 2011: the cabinet of officiating Prime Minister Madhav Nepal has decided three days ago to transfer the high-level state staffs: Secretary to the Ministry of Land Reform Chhabi Raj Panta to the Western Regional Administration Office and Secretary to the Kathmandu Metropolitan Office Ananda Pokharel to Mid Western Administration Office disregarding the Civil Service Act and Regulations, myrepublica.com reports. Secretary Panta has been the senior most official in the civil service. So, he has said that the decision made by the cabinet is unacceptable to him because it goes against the law, and refused to take the new position following the cabinet decision.
According to myrepublica.com, Chief Secretary to the council of ministers Madhav Ghimire has spent two hours today on persuading the prime minister to change the decision that goes against the law; ultimately officiating Prime Minister Madhav Nepal has given in and has transferred Secretary Panta to the office of prime minister and council of ministers and Secretary Pokharel to the Information Commission
Madhav Nepal does not need to follow any rules and regulations and laws because he himself has been prime minister not following the democratic norms, principles and values. He needs to enjoy the life as long as he remains at the office of prime minister and make money as much as possible to keep going his cadres.
Following the Civil Service Act and Regulations, the cabinet cannot transfer any senior secretary to remote areas or make him/her work under anybody junior to him/her. In addition, the cabinet needs to seek the approval of the concerned secretary before transferring him/her to a new ministry if the secretary in question has reached the mandatory retirement in a year or less.
